1. Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the website hiscoxcases.us and any purchases made through it, operated by SBRP LLC ("Company," "we," "us," or "our"). By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully before making a purchase.

1.1 Acceptance of Terms

By accessing, browsing, or using this website, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you do not agree with any part of these Terms, you must not use our website or place an order.

1.2 Products and Pricing

All products listed on hiscoxcases.us are subject to availability. We reserve the right to discontinue any product at any time without notice. Prices are listed in U.S. Dollars (USD) and are subject to change without notice. We make reasonable efforts to display product information accurately; however, we do not warrant that product descriptions, pricing, or other content is complete, accurate, or error-free. We reserve the right to refuse or cancel any order, including orders where pricing errors have occurred.

1.3 Orders and Payment

When you place an order, you represent that: (a) all information provided is accurate and complete; (b) you are authorized to use the payment method provided; and (c) your order will not violate any applicable law. Orders are not binding until confirmed by us via email. We accept major credit cards and other payment methods displayed at checkout. Your payment information is processed securely by our payment processor and is not stored on our servers.

1.4 Sales Tax

SBRP LLC collects and remits applicable sales and use taxes in states where we have nexus under applicable law, including economic nexus standards established by South Dakota v. Wayfair, 585 U.S. 130 (2018). The applicable tax amount will be calculated and displayed at checkout based on your shipping address. Tax rates are subject to change in accordance with applicable state and local laws.

1.5 Order Fulfillment — FTC Mail Order Rule

In accordance with the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435), we will ship your order within the timeframe stated on our website or at the time of your order. If we are unable to fulfill your order within the promised timeframe, we will notify you and provide the option to cancel for a full refund or consent to a revised shipping date.

1.6 Intellectual Property

All content on hiscoxcases.us — including text, images, logos, product descriptions, and graphics — is the property of SBRP LLC or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

1.7 Limitation of Liability

To the fullest extent permitted by applicable law, SBRP LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to these Terms or your purchase shall not exceed the amount paid by you for the specific product giving rise to the claim. Some states do not allow limitations on implied warranties or consequential damages, so the above limitations may not apply to you.

1.8 Disclaimer of Warranties

The website and products are provided on an "as is" and "as available" basis. SBRP LLC makes no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated in our Warranty Policy. Some states do not allow the exclusion of implied warranties, so this disclaimer may not apply to you in its entirety.

1.9 Force Majeure

SBRP LLC shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from causes beyond our reasonable control, including but not limited to natural disasters, acts of God, pandemics, governmental actions, supply chain disruptions, carrier failures, or labor disputes. In such circumstances, we will notify you promptly and make commercially reasonable efforts to resume performance.

1.10 FTC Compliance — Prohibition on Deceptive Practices

All representations made on this website, including product descriptions, pricing, promotions, and endorsements, comply with the Federal Trade Commission Act (15 U.S.C. § 45) and applicable FTC regulations and guidelines. We do not engage in unfair or deceptive acts or practices. Consumer reviews and testimonials, if displayed, reflect genuine customer experiences and have not been materially edited or incentivized without disclosure.

1.11 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be subject to good-faith informal resolution by contacting us at info@hiscoxcases.com. If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Baltimore County, Maryland. Nothing in this section limits your rights under applicable federal or state consumer protection laws.

1.12 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

1.13 Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the website with an updated effective date. Your continued use of the website following any changes constitutes your acceptance of the revised Terms.

2. Privacy Policy

2.1 Who We Are

SBRP LLC ("we," "us," or "our") operates hiscoxcases.us, an online retailer of instrument cases based in Glen Arm, Maryland. We act as the "controller" or "business" with respect to personal data collected through this website.

2.2 Data Minimization

In accordance with applicable privacy laws, including the Maryland Online Data Privacy Act, we limit our collection and processing of personal data to what is strictly necessary to provide you with the products and services you request. We do not collect personal data speculatively or for purposes beyond those described in this Policy.

2.3 Information We Collect

These providers are contractually prohibited from using your data for any purpose other than providing services to us.
  • Legal requirements: We may disclose information when required by law, court order, or government authority, or to protect our legal rights and those of our customers.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction. We will notify you of any such change in control.

Categories of third parties to which we have disclosed personal data: shipping and logistics providers, payment processors, e-commerce platform providers.

2.6 Data Retention

We retain personal information only as long as necessary to fulfill the purposes described in this Policy:

  • Transaction records (name, address, order details, payment method type): 7 years, as required for tax and accounting compliance under federal and Maryland state law
  • Customer service communications: up to 3 years from the date of the interaction
  • Website analytics data: retained in aggregate, anonymized form indefinitely; individual session data is not retained beyond 26 months

2.7 Your Privacy Rights

Rights Available to All Consumers

  • Right to Delete: your personal information, subject to certain legal exceptions

Additional Rights for California Residents (CCPA/CPRA)

California residents have the right to opt out of the sale or sharing of personal information and to limit the use of sensitive personal information. We do not sell or share personal information for cross-context behavioral advertising. California residents may also submit requests through an authorized agent.

Additional Rights for Maryland Residents (MODPA)

Maryland residents have the right to obtain a list of the categories of third parties to which we have disclosed their personal information, the right to appeal any denial of a privacy rights request (see Section 2.9), and the right to opt out of any future sale of personal data (we do not currently sell personal data).

Rights in Colorado, Connecticut, Virginia, Texas, Oregon, Nebraska, and Other States

Residents of states with enacted consumer privacy laws have rights to access, correct, delete, and obtain a portable copy of their personal data, as well as the right to opt out of targeted advertising and profiling (neither of which we engage in). State-specific rights will be honored in accordance with applicable law.

2.8 How to Submit a Privacy Rights Request

To exercise any of your privacy rights, please contact us at: info@hiscoxcases.com. Please include your full name, the state in which you reside, and a description of your request. We will verify your identity before processing your request. We do not charge a fee for processing requests unless they are manifestly unfounded or excessive.

2.9 Right to Appeal

If we deny your privacy rights request, we will provide you with a written explanation of our reasoning. You may appeal our decision by submitting a written appeal to info@hiscoxcases.com with the subject line "Privacy Rights Appeal." We will respond to your appeal within 60 days. If your appeal is denied, you may contact your state's Attorney General office to submit a complaint.

2.10 Universal Opt-Out — Global Privacy Control

We honor the Global Privacy Control (GPC) signal, a browser-based preference that instructs websites not to sell or share your personal data. If your browser or browser extension sends a GPC signal when you visit hiscoxcases.us, we will treat this as an opt-out request from the sale or sharing of your personal data (noting that we do not currently engage in such activities). 2.11 Data Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These include SSL/TLS encryption for all data transmitted to and from our website and access controls for systems storing personal data. In the event of a data breach that triggers applicable state notification obligations, we will notify affected individuals and relevant authorities as required by law. All 50 states have enacted data breach notification laws.

2.12 Children's Privacy — COPPA

Our website is not directed to individuals under the age of 13, and we do not knowingly collect personal information from children under 13 in accordance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506. We do not sell the personal data of any consumer under the age of 18. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at info@hiscoxcases.com and we will delete such information promptly.

2.13 Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will post the updated Policy on our website with a revised effective date. For material changes, we will provide additional notice, such as a prominent website notice or email notification to recent customers.

3. Return & Refund Policy

We want you to be completely satisfied with your Hiscox case. If you are not happy with your purchase for any reason, please review the following policy.

3.1 Return Window

You may return most items within 14 days of the confirmed delivery date. To be eligible for a return, your item must be:

  • Unused and in the same condition that you received it
  • In its original, undamaged packaging with all included accessories, foam inserts, and documentation
  • Accompanied by your order number or proof of purchase

Note: The United States does not impose a federal mandatory minimum return period for online retailers. Our 14-day policy exceeds the minimum required by applicable law in most states. We reserve the right to update this policy in response to any future state-mandated minimum return windows.

3.2 Non-Returnable Items

The following items are not eligible for return:

  • Items that have been used, modified, or damaged by the customer
  • Custom or special-order products
  • Items explicitly marked as final sale at the time of purchase

3.3 How to Initiate a Return

To initiate a return, email info@hiscoxcases.com within 14 days of delivery. Include your order number, the item(s) you wish to return, and the reason for the return. We will issue a Return Merchandise Authorization (RMA) number and return instructions within 2 business days. Returns received without a valid RMA number may not be accepted or processed.

3.4 Refunds

Once we receive and inspect your returned item, we will notify you by email of our decision. If the return is approved, a refund will be issued to your original payment method within 5–10 business days. Please note that your bank or credit card company may require additional processing time before the refund is visible on your account.

Refunds will be for the purchase price of the returned item. Original shipping charges are non-refundable unless the return is due to our error or a product defect.

3.5 Return Shipping

Return shipping costs are the responsibility of the customer unless the return is due to our error (wrong item shipped), a product defect, or damage in transit. In such cases, we will provide a prepaid return shipping label.

3.6 Damaged or Defective Items — FTC Rule Compliance

If you receive a damaged or defective item, please contact us at info@hiscoxcases.com within 5 business days of delivery with photographic documentation of the damage. We will arrange a prepaid return and provide either a full replacement or a complete refund, at your election, at no additional cost to you. This remedy is in addition to, and does not limit, any rights you may have under our Warranty Policy or applicable consumer protection laws.

3.7 Exchanges

We do not process direct exchanges. To receive a different item, please return the original product in accordance with this policy and place a new order for the desired item.


4. Shipping Policy

4.1 Shipping Origin — Domestic US Fulfillment

All orders are fulfilled and shipped from our facility in Glen Arm, Maryland, USA. Because we ship domestically within the United States, there are no import fees, customs duties, or international shipping surcharges for U.S. customers.

4.2 Processing Time — FTC Mail Order Rule

In accordance with the FTC Mail Order Rule (16 C.F.R. Part 435), orders are typically processed and shipped within 1–3 business days of receipt. If we are unable to ship within this timeframe, we will notify you by email and provide the option to consent to a revised shipment date or cancel your order for a full refund. Orders placed on weekends or federal holidays begin processing on the next business day.

4.3 Shipping Methods and Estimated Delivery

We ship via major U.S. carriers including UPS, FedEx, and USPS. Estimated transit times after shipment:

  • Standard Shipping: 3–7 business days
  • Expedited Shipping: 2–3 business days (where available)
  • Overnight Shipping: 1 business day (where available)

Delivery estimates are not guaranteed. Carrier delays, weather events, high-volume periods, and other factors outside our control may affect delivery times.

4.4 Shipping Costs

Shipping costs are calculated at checkout based on destination, package weight, and selected shipping method. Free shipping promotions are applied automatically when applicable and will be displayed at checkout.

4.5 Geographic Coverage

hiscoxcases.us ships to all 50 U.S. states, including Alaska and Hawaii. We do not currently ship to U.S. territories (Puerto Rico, Guam, U.S. Virgin Islands, etc.) or international destinations through this website.

4.6 Lost or Stolen Packages

If your tracking information shows your package as delivered but you have not received it, please: (1) check with neighbors and building management; (2) wait 24 hours, as packages are occasionally marked as delivered prematurely; (3) contact the carrier directly with your tracking number to file a trace. If the issue remains unresolved within 3 business days, contact us at info@hiscoxcases.com and we will assist with filing a carrier claim.

4.7 Address Accuracy

You are responsible for ensuring that your shipping address is correct at the time of ordering. We are not liable for orders shipped to an incorrect address provided by the customer. If you notice an error immediately after placing an order, contact us at info@hiscoxcases.com as soon as possible and we will make commercially reasonable efforts to correct the address before shipment.


5. Warranty Policy

5.1 Limited Warranty

SBRP LLC warrants that Hiscox Cases products purchased through hiscoxcases.us are free from defects in materials and workmanship for a period of 2 (two) years from the date of original purchase ("Warranty Period"). This warranty is provided in addition to, and does not limit, any implied warranties that cannot be disclaimed under applicable state law.

5.2 What This Warranty Covers

This warranty covers:

  • Defects in materials used in the construction of the case
  • Manufacturing defects in hardware, latches, hinges, handles, and closures
  • Delamination or structural failure under normal use conditions
  • Failures due to faulty workmanship that occur during the Warranty Period under normal use

5.3 What This Warranty Does Not Cover

This warranty does not cover:

  • Damage caused by accident, abuse, misuse, negligence, or improper storage
  • Normal wear and tear, including surface scratches, scuffs, fading, and cosmetic wear
  • Damage caused by exposure to extreme temperatures, moisture, or chemicals beyond typical use
  • Unauthorized modifications, repairs, or alterations
  • Damage to the contents of the case or consequential losses
  • Products not purchased directly through hiscoxcases.us or authorized resellers

5.4 State Law Rights

Some states do not allow limitations on the duration of implied warranties or exclusion of incidental or consequential damages. The limitations in this Warranty Policy may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

5.5 How to Make a Warranty Claim

To submit a warranty claim, contact us at info@hiscoxcases.com with: (1) your order number or original purchase receipt; (2) a description of the defect or failure; and (3) photographs clearly documenting the issue. We will evaluate your claim and respond within 5 business days.

5.6 Remedy

If a warranty claim is approved, we will, at our sole discretion: (a) repair the defective product; (b) replace it with the same or functionally equivalent model; or (c) issue a refund of the original purchase price. Replacement products are covered for the remainder of the original Warranty Period or 90 days, whichever is longer.

5.7 Limitation of Warranty

EXCEPT AS EXPRESSLY SET FORTH IN THIS POLICY, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SBRP LLC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS WARRANTY IS YOUR EXCLUSIVE REMEDY FOR PRODUCT DEFECTS.
